Consolidation across the health care market, whether among hospitals, other providers, health plans, pharmacy benefit managers, etc., is helping to increase costs and decrease transparency. The Federal Trade Commission (FTC) and the Department of Justice (DOJ) have released draft merger guidelines that describe federal agencies’ review of mergers and acquisitions to determine compliance with federal antitrust laws for the public comment (due by September 18, 2023).
NASHP is convening a state-only call to discuss how these proposed guidelines could impact the changing health care market. After an overview of the proposed federal guidelines, there will be time for state questions and discussion.
