Additional Resources for OSHA COVID-19 Vaccination and Testing ETS

OSHA has provided a Summary: COVID-19 Vaccination and Testing ETS for information about the COVID-19 ETS. “Employers are required to comply with safety and health standards promulgated by OSHA or by a state with an OSHA-approved state plan…this summary is not itself a standard or regulation and it creates no new legal obligations.”   In short, use the summary as a reference but be sure to follow the OSHA regulation itself if you are an employer with 100 or more employees. The OSHA ETS (OSHA-2021-0007) is a complementary regulation in conjunction with CMS-3415-IFC.

The ETS was officially published in the Federal Registeron Friday, November 5, 2021.  It’s 154 pages in length. The Rule is effective November 5, 2021, the date of publication.

By now, you may have heard that a federal appeals panel (3-judge panel from the U.S. Court of Appeals for the Fifth Circuit in Louisiana) on Saturday temporarily blocked this new coronavirus vaccine mandate. This stay does not have an immediate impact on the ETS. We will hear more in the coming days as the vaccine mandate is a political hot topic and more courts are likely to get involved.
